Institute of Positive Fashion Forum 2021 Terms & Conditions

The terms and conditions below (“Terms and Conditions”) set out the agreement between us, British Fashion Council, and you in relation to your purchase and use of any Tickets to the Event.

Any person who purchases or possesses a Ticket, or uses or attempts to use any Ticket shall be deemed to have accepted and agreed to comply with these Terms and Conditions. 

  • Definitions and interpretations

In these Terms and Conditions the following terms shall have the following meanings:

“Event”

means the Institute of Positive Fashion Forum 2021 taking place on Thursday 10th June 2021 on the Institute of Positive Fashion website.;

“Force Majeure”

means: (a) any cause preventing the British Fashion Council from hosting or staging the Event (in whole or part) at the Venue or otherwise from entering the Venue due to any unavailability of the Venue or any actions or omissions of the Venue owner; or (b) where the following occurs or there exists a real likelihood or material threat of the following occurring: any other event, act, statute rule regulation or act of any government or any other legally constituted authority, non-happening, omission or accident (including without limitation fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters, acts of God, war (whether declared or not), threat of or preparation for war, terrorist activity, failure of public utilities or civil commotion, royal demise) beyond the British Fashion Council’s reasonable control;

“Guest”

means any individual invited by you or accompanying you to the Event and to whom you have provided a Ticket;

“person”

means an individual, partnership, firm, corporation, association, trust, unincorporated association or any other legal person;

“Terms and Conditions”

means the terms and conditions set out below, together with any rules and regulations of the owner or operator of the Venue (full details of which are available at the Venue ticket office and/or on the Venue website) and any other rules brought to your attention prior to purchasing the Ticket or entry into the Venue;

“Tickets”

means evidence of a personal revocable licence for an individual to access the Venue and attend online

“Venue”

means the venue in which the Institute of Positive Fashion Forum 2021 will be held

“we/us”

means British Fashion Council, a company limited by guarantee, registered under company number 02050620 whose registered office is at Fora, 33 Broadwick Street, Soho, London W1F 0DQ; and

“you”

means the purchaser or the holder of the Ticket.

 

  • General
    • All Tickets are sold and issued subject to these Terms and Conditions.
    • By purchasing a Ticket or holding or using a Ticket, you agree to comply with these Terms and Conditions. You will ensure that any Guest also complies with these Terms and Conditions.

    • If you do not (or any Guest does not) comply with these Terms and Conditions, both we and the Venue may terminate the licence(s) granted and remove you (or any Guest) from the platform.
    • The terms and conditions in force on the day you purchase the Ticket shall apply. However, we reserve the absolute right to change these Terms and Conditions from time to time without notice. Accordingly, you should check these terms and conditions each time you make a purchase.

 

  • Ticket Purchase
    • Tickets may only be purchased from us. Any Tickets purchased or obtained from any other source shall be voidable by us or the Venue (at our option) and may be seized or cancelled by us or the Venue without refund or compensation.
    • You should be aware that we will use the information provided to us in the booking form in order to contact you and/or to fulfil any orders. You should ensure that all information provided is correct and legible. We shall be liable for the incorrect entry of information or for any lost, incomplete or illegible booking forms.
    • When you place an order for Tickets, you are offering to buy the tickets specified in your order. All Tickets are subject to availability and orders are subject to acceptance by us. Where we accept an order, we will confirm your purchase by email to that address you purchased with.
    • On acceptance of your order, we will also send you an invoice for the total value of the Tickets you have purchased together with any applicable VAT that may be payable. Such invoices are due payable immediately on receipt.
    • If you do not pay such invoice: (a) within 30 days of the date of the invoice; or (b) if the Event date is less than two months away at the time we send you an invoice, within five days of the invoice date; then we shall have the right to immediately cancel your order of Tickets and resell them. Where we cancel your order, we will inform you by email to that address set out in the booking form.
    • We may, in our absolute discretion, refuse any order or cancel any order or withdraw any Tickets where we believe you (or any Guest) plan to offer a Ticket or Tickets for resale (or have resold any such Tickets) or where the purchase or use of such Tickets is otherwise in breach of these Terms and Conditions.
    • The price of the Tickets is set out in the booking form (or as otherwise notified by us to you prior to acceptance of your offer). All prices are inclusive of any applicable taxes but exclusive of any booking fees and collection or secure delivery fees.
    • Sales of any Tickets are final. No changes, cancellation or exchange of any Tickets (or any element of such Tickets) will be permitted, except as specifically set out in these Terms and Conditions or as authorised and facilitated by us from time to time (in our absolute discretion).

 

  • Delivery
    • Tickets will be issued to you via email to the email address you have provided to us in the booking form.
    • Once received, you are solely responsible for safeguarding all Tickets. It may not be possible to issue duplicate Tickets.
    • You are responsible for checking all Tickets on receipt as mistakes cannot necessarily be rectified later. If there has been any mistake you must contact us without delay.

 

  • Tickets
    • Each Ticket will grant to you a personal right of entry to the Venue to attend and to occupy a space or seat at the Event.
    • Tickets shall remain the property of the British Fashion Council.
    • A valid Ticket must be produced to gain admission to the Venue and your designed space or seat in the Venue.

 

  • Event Alterations and Interruptions
    • You acknowledge that the Event may be delayed, interrupted, rescheduled or postponed. We will use our reasonable efforts to communicate such delays, interruptions, rescheduling or postponements to you (using the information provided). As soon as possible after we become aware that the Event has been or will be delayed, interrupted, rescheduled or postponed, all available information will be posted on fashionawards.com. It is your responsibility to ascertain whether the Event has been delayed, interrupted, rescheduled or postponed and any new dates and times. We cannot guarantee that you will be informed of such delay, interruption, rescheduling or postponement before the date of the Event.
    • If the Event’s scheduled start time is delayed but not postponed, you will not be eligible for a refund.
    • If the Event commences as scheduled and is interrupted after it begins, you will not be eligible for a refund.
    • If the Event is postponed, you may retain your original Ticket for admission to the rescheduled Event. However, you will not be eligible for a refund.

 

  • Event Cancellation
    • If the Event is cancelled (i.e. not held at all), we will use our reasonable efforts to let you know the Event has been cancelled (using the information provided). As soon as possible after we become aware of the Event being cancelled all available information will be posted oncom It is your responsibility to ascertain whether the Event has been cancelled. We do not guarantee that you will be informed of such cancellation before the date of the Event.
    • If the Event is cancelled, then you may apply for a refund.
    • Any refund will be processed by us.
    • If you are entitled to a refund, you must provide us by email your receipt and proof of purchase than 30 days after the day on which the Event is cancelled.
    • Any refund properly due under these Terms and Conditions will be provided via the payment method used to purchase the Tickets. We shall endeavour to process all refunds promptly.
    • Refunds will only be made to the original purchaser of the Tickets and not any subsequent holder of the Tickets. Refunds will be given up to the face value of the Tickets purchased. This is the only remedy. There will be no exchanges of Ticket to an alternative event or refund of any applicable delivery charges, booking fees or other charges.

 

  • Liability
    • We will not be responsible for any business or economic losses including but not limited to: loss of profit; revenue; contracts; anticipated savings; or opportunity; or any other indirect loss that was not reasonably foreseeable to both us and you when the order was made. However, subject to clause 2 and 8.3, we will be responsible to you for any losses you suffer as a result of a breach by us of these Terms and Conditions where those losses were reasonably foreseeable to both you and us at the date you place your order.
    • Subject to clause 3, in any event our maximum liability to you (or any Guest) under these terms and Conditions is to refund to you the price paid by you for the relevant Ticket.
    • Nothing in these Terms and Conditions shall reduce or limit our liability for death or personal injury or damage to your property where caused by our negligence or by our deliberate act or omission.

 

  • Personal Data
    • Information about you is gathered and stored to identify you and for administration, communication, enforcement and access control purposes.
    • You irrevocably and unconditionally consent to the collection and processing by us of personal information provided to us in accordance with these Terms and Conditions and in accordance with our privacy policy, http://www.fashionawards.com/Privacy-Policy, for the purposes of the implementation of these Terms and Conditions, including for administration, communication, enforcement and access control purposes and as otherwise set out in our privacy policy. You have a right of access to and to correct your personal information by written request.
    • We will use reasonable endeavours to ensure the safety and security of any personal information you provide to us. However, except as set out in law, we shall not be responsible for any loss, theft or accidental destruction of any personal information provided to us or any financial loss or other damage which may result directly or indirectly therefrom.

 

  • Transfer, Resale and Use of Tickets
    • All Tickets are strictly non-transferable and must not be: sold; advertised for sale (whether on the internet, in newspapers or elsewhere); transferred to any person who pays or agrees to pay for some other goods and/or services; nor offered as part of a package of goods or services.
    • If you purchase more than one Ticket, the Tickets may only be used by you, member(s) of your family, friend(s) or colleague(s) who are known to you personally and who intend to accompany you to the Event.
    • Tickets may not be used for advertising, promotion, auctions, fundraising or marketing purposes (including as prizes in competitions, contests or sweepstakes).
    • Tickets used for advertising, promotion, auctions, fundraising or marketing purposes without our authorisation (including in competitions, contests or sweepstakes) or otherwise used or transferred or obtained in breach of these Terms and Conditions shall be voidable (at our discretion) and may be seized or cancelled without refund or without granting entry to the Venue.
    • Any person seeking to use a Ticket obtained in breach of these Terms and Conditions in order to gain entry to or remain at the Event may be considered to be a trespasser and may be liable to be ejected and liable to legal action.

 

  • Filming, Photography and Taping
    • You consent (and shall ensure that your Guests consent) to being photographed, filmed or taped, by us, by the Venue or by any third party appointed and/or authorised by us or them.
    • We, the Venue or third parties appointed and/or authorised by us or them shall have the right to broadcast, publish, licence and use any such photographs, films, recordings or images of you or your Guests in perpetuity without requirement of the payment of money or other form of consideration.
    • Images, video and sound recordings of the Event taken by you or any Guest cannot be used for any purpose other than for private and domestic purposes and neither you nor any Guest may licence, broadcast or publish video and/or sound recordings, including on social networking websites and the internet more generally, and may not exploit images, video and/or sound recordings for commercial purposes under any circumstances, whether on the internet or otherwise, or make them available to third parties for commercial purposes.

 

  • General
    • You and your Guests should allow sufficient time before the commencement of the Event to access the Venue.
    • These Terms and Conditions shall not affect your statutory rights as a consumer.
    • If we or the Venue delay or fail to enforce any of these Terms and Conditions it shall not mean that we or the Venue have waived our right to do so at any subsequent time.
    • If any of these Terms and Conditions cannot be enforced for any reason this shall not prevent the remaining provisions from continuing to apply.
    • Any person, other than the Venue, not party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999.
    • These Terms and Conditions constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Terms and Conditions or any Ticket which is not already set out in these Terms and Conditions.
    • The Terms and Conditions are governed by English Law and any disputes arising out of any transaction with us are subject to the exclusive jurisdiction of the English Courts.
